This public offer agreement (the “Agreement”) is an offer by Protelle (the “Seller”) to enter into a contract for the sale of the goods presented on https://protelleprotein.com (the “Site”) on the terms set out below. Placing an order on the Site constitutes full and unconditional acceptance of these terms.

1. General provisions

1.1. The offer is the Seller’s proposal setting out the terms on which goods are bought through the Site.

1.2. The Buyer’s acceptance of the offer confirms agreement with all terms of this Agreement; the Agreement is concluded from the moment of acceptance.

2. Rights and obligations of the parties

2.1. The Seller undertakes to:

  • supply the goods in the quantity and range stated in the order;
  • hand the goods to the carrier within the agreed time;
  • reimburse the Buyer’s costs of returning goods that do not conform to the Agreement.

2.2. The Buyer undertakes to:

  • provide correct and accurate information when placing an order;
  • accept goods that conform to the Agreement;
  • pay for the goods by the chosen payment method.

3. Price and payment

3.1. Prices are shown on the Site in Ukrainian hryvnia. The Seller may change prices; the price of an order already placed does not change.

3.2. Payment is made by the methods shown on the Site at checkout.

4. Delivery

4.1. Delivery within Ukraine is by Nova Poshta.

4.2. The Buyer pays for delivery on receipt, at the carrier’s rates. Current terms are on the Shipping and payment page.

5. Returns and exchanges

5.1. Returns and exchanges follow Ukrainian law and the Refund policy. Food products of proper quality cannot be returned; goods that are defective, damaged, past their date or delivered in error are replaced or refunded by the Seller.

6. Intellectual property

6.1. Texts, images, logos and other materials on the Site belong to the Seller or to their respective rights holders and may not be used without their consent.

7. Liability

7.1. The Seller is not liable for failure to fulfil an order due to force majeure.

7.2. The Buyer is responsible for the accuracy of the delivery address and contact details provided.

8. Final provisions

8.1. This Agreement applies in Ukraine and is governed by the law of Ukraine.

8.2. The Seller may change the terms of this Agreement by publishing a new version on the Site. The new version applies to orders placed after its publication.

8.3. Nothing in this Agreement limits the consumer rights provided by consumer protection law.

8.4. This English text is a translation provided for convenience; if it differs from the Ukrainian version, the Ukrainian version prevails.
